Pinging Future Posts // api files uploading

i've created a post and set the date in 14 hours tomorrow, and hit the publish link.
i noticed that s9y sends the pings and notifications to the link in the entry disregarding the publishing time part.

how can this be fixed. and when these people get the ping before the post is out, will they be able to view it and make sure that this isn't a spam?

i'm uploading most the posts attachments/images through api not the media manager; what about file names? 2 or more posts with the same image called logo.jpg for example? will s9y rename it?

Yes, this is a known issue and is in our todo list. Technically, this is hard to solve.

But nobody can view the entry unless its published.

s9y should auto-numberate duplicate files, yes. At least this is how it's when you upload through the media manager. I can't tell you if that's the same for API uploads.
